The present general conditions of sale, dated 09/09/2022, are applicable from 09/09/2022. They can be modified at any time without notice. The customer is therefore invited to read them before each order.

They are concluded on the one hand by SOLIS ISLAND, SAS whose head office is in Le Gosier Guadeloupe, whose SIRET number is 92128871800015 and on the other hand, by any natural or legal person wishing to proceed to a purchase via the Internet site www.solisisland.com

OBJECT
The general sales conditions described hereafter detail the rights and obligations of SOLIS ISLAND and of its customers within the framework of the sales made from the www.solisisland.com site. They concern the following merchandise: tanning cosmetics and sun care products, accessories and equipment for individuals and professionals. Any service performed by SOLIS ISLAND therefore implies the buyer's unreserved adherence to these general sales conditions.



PRESENTATION OF THE PRODUCTS
The characteristics of the products offered for sale are presented in the product sheets of our site. The photographs do not enter the contractual field. SOLIS ISLAND's responsibility cannot be engaged if errors have been introduced. All texts and images presented on the www.solisisland.com site are reserved, for the whole world, under the copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden.

PRICES
The prices appearing in the catalog are prices TTC in euros there is 20 percent of VAT included because the regime of SOLIS ISLAND is a SAS.

The shipping costs as well as the order processing costs appear on the "basket" screen at the end of the selection of the different products by the customer.

The proposed rates include the discounts and rebates that SOLIS ISLAND would have to grant.

No discount will be granted in case of advance payment.

GEOGRAPHICAL AREA AND LANGUAGE
The online sale of the products and services presented on the site is reserved for buyers who reside in France, Belgium, Switzerland, the Dom-Tom or Monaco and for deliveries required in these geographical areas. However, SOLIS ISLAND, upon request, will accept online sales to buyers residing in other countries of the world.

The site is published only in French and may offer the option of translation into English. This language is used during the pre-contractual relationship as well as for the conclusion of the contract.



ONLINE ORDERING PROCESS
The ordering process includes the following steps:

> The customer selects the product he/she wishes to purchase.

> The customer accesses his virtual basket which summarizes his order with the prices and the number of items he has selected, as well as the shipping costs that will be applied, if he chooses the lowest price, before the payment step. He is invited to check his order, in order to correct any errors.

> The "ORDER" button gives access to the following steps.

> The customer is invited to create a customer account or to connect to his customer account if he already has one.

> The customer fills out a form with the information necessary for identification and order processing: title, first name, last name, postal address, delivery address, telephone number, e-mail address.

> The customer is invited to specify a delivery and billing address, as well as to leave a message, for the attention of SOLIS ISLAND's customer service, if necessary.

> By clicking on "ORDER", the customer accesses the different delivery methods offered, with different rates. The customer chooses the delivery method. He is informed of the actual amount of the delivery costs before proceeding with the payment of his order. The customer must validate the general terms and conditions of sale, which can be consulted at this stage, or at the bottom of the site.

> The customer is then invited to choose his means of payment and to proceed to the online payment on a secured page.

> The order is firm when the company receives payment from the client.

> Solis Island confirms the order by e-mail.

The data recorded by the SOLIS ISLAND site constitute the proof of the nature, the content and the date of the order. The latter is archived by SOLIS ISLAND under the conditions and within the legal deadlines; the customer can access this archiving by contacting the Customer Relations department.

RETRACTATION
In accordance with article L.221-21 of the consumer code, the customer has a fourteen clear days deadline, as of the reception of the products, to exercise his right of retraction without having to justify the reasons nor to pay any penalty, with the exception, if necessary, of the return expenses.

The consumer who wishes to exercise his right of retraction must inform the company SOLIS ISLAND by sending, within the above-mentioned delay, a retraction email with a form to be requested and sent to contact@solisisland.com

The consumer who has validly exercised his right of withdrawal must return the goods to the company no later than fourteen days following the decision to withdraw. The responsibility of the consumer can be engaged in case of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

When the right of withdrawal is exercised, the company reimburses the consumer of the totality of the sums paid, by deducting the delivery and the 20%. The refund will be made without undue delay and no later than fourteen days from the date on which the company is informed of the consumer's decision to withdraw. However, if the goods have not been received by the end of this period, the company may postpone the refund until the goods have been recovered, or until the consumer has provided proof of shipment of the goods, whichever comes first. The refund will be made using the same method of payment as the one used by the consumer for the initial transaction, unless the consumer expressly agrees to use another method of payment and insofar as the refund does not incur costs for the consumer.

The product must be returned in perfect condition, in its original packaging, unopened, unsealed, undamaged and unmarked. The product must be accompanied by all its accessories and a copy of the purchase invoice.



TERMS OF PAYMENT
The price is due at the time of order. Payments will be made by credit card; they will be made through the secure system of STRIPE which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can gain knowledge of it during transport on the network.



LATE PAYMENT (CLAUSE APPLICABLE TO PROFESSIONALS)
In case of total or partial non-payment of the delivered goods on the day of receipt, the buyer must pay SOLIS ISLAND a late payment penalty equal to one and a half times the legal interest rate.

The legal interest rate retained is the one in effect on the day of delivery of the goods.

This penalty is calculated on the amount of the outstanding amount, excluding taxes, and runs from the due date of the price without any prior notice of default being required.

In accordance with articles 441-6c. com. and D.441-5c. com, any delay in payment automatically entails, in addition to the late payment penalties, an obligation for the debtor to pay a fixed indemnity of 40€ for collection costs.

An additional indemnity may be claimed, upon justification, when the collection costs are higher than the amount of the fixed indemnity.

DELIVERIES
Deliveries are made to the address indicated in the order form, which can only be in the agreed geographical area.

Delivery costs are at the customer's expense, unless otherwise stated on the site. They depend on: the weight and characteristics of the product, the place of delivery, as well as the mode and time of delivery selected by the customer. The amount of the delivery costs is indicated to the customer during the ordering process, before the validation of the order.

The customer must mention any possible reservation at the time of delivery.



RESERVATION OF OWNERSHIP
The products will remain the exclusive property of the company SOLIS ISLAND until their complete payment. The company's right of resale will also apply, if necessary, to the price or to the part of the resale price of these goods, as well as to the insurance indemnity that would be subrogated to them. The customer will take all necessary measures to duly inform his creditors in due time.

LEGAL WARRANTY AND CLAIMS
All products supplied by the seller benefit from the legal guarantee of conformity provided by articles L.211-4 to L.211-13 of the Consumer Code. It also benefits from the guarantee of the defects of the thing sold under the conditions envisaged in articles 1641 to 1648 and 2232 of the civil code. In case of non-conformity of a sold product, it can be returned to the seller who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by email to contact@solisisland.com

RESPONSIBILITY
The salesman, in the process of online sale, is held only by an obligation of means; his responsibility will not be able to be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of service, or other involuntary problems. Intellectual property All the elements of the SOLIS ISLAND site are and remain the exclusive intellectual property of SOLIS ISLAND. No one is authorized to reproduce, exploit, rebroadcast, or use in any way whatsoever, even partially, elements of the site, whether they be software, visual or sound. Any simple or hypertext link is strictly forbidden without a written agreement from SOLIS ISLAND.


DATA OF A PERSONAL NATURE
In accordance with the law relative to data processing, files and freedoms of January 6, 1978, the information of a nominative nature relative to the purchasers can be the object of an automated treatment. SOLIS ISLAND reserves the right to collect information on the buyers, including by using cookies. The buyers can oppose the disclosure of their coordinates by indicating it to SOLIS ISLAND. In the same way, the users have a right of access and rectification of the data concerning them, in accordance with the law of January 6, 1978. The automated processing of information, including the management of the e-mail addresses of the site's users, has been declared to the CNIL.

Purpose of the data collected:

SOLIS ISLAND is likely to process all or part of the data:

to enable navigation on the Site and the management and traceability of the services ordered by the user: connection and use data of the Site, billing, order history, etc.
to prevent and fight against computer fraud (spamming, hacking...): computer equipment used for navigation, IP address, password (hashed)
to improve navigation on the Site: connection and usage data
to conduct optional satisfaction surveys: email address
to conduct communication campaigns (sms, email): phone number, email address

ARCHIVING
SOLIS ISLAND will archive the order forms and the invoices on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. SOLIS ISLAND's computerized registers will be considered by the parties as proof of the communications, orders, payments and transactions that occurred between the parties.


DISPUTES
In the event of a dispute, the parties may resort to a conventional mediation procedure or to any other alternative dispute resolution method.

The consumer may refer to the competent French court under Articles 42 to 46 of the Code of Civil Procedure or Article R.631-3 of the Consumer Code.

If the consumer is not domiciled in France but in another European Union Member State, jurisdiction is defined by Articles 17 to 19 of the European Union Regulation n°1215/2012 of December 12, 2012. By way of derogation, the French courts shall have exclusive jurisdiction to hear any dispute that may arise between the company and the consumer if the latter has, at the time of the conclusion of the contract, his domicile or habitual residence in France; the consumer expressly consents to the present clause attributing jurisdiction to the French courts.
